The sale or supply of alcoholic beverages to minors under the age of 18 is prohibited.

General Application Clause

Placing an order with our association implies the customer’s unconditional acceptance of the General Terms and Conditions of Sale set out below. These Terms and Conditions shall prevail over any contrary clause that may appear on the purchaser’s order form or any other equivalent document.

Any deviation from these Terms and Conditions must be agreed upon in advance and recorded in writing.

Protection of Minors

In accordance with Article L.3342-1 of the French Public Health Code, the sale of alcohol to minors under the age of 18 is prohibited in France.

Any person wishing to purchase alcoholic beverages from the Office de Tourisme Intercommunal Aspres Thuir therefore undertakes to be at least 18 years old at the time of ordering and to enter their true date of birth in the field provided for this purpose on the order form.

Data Protection and Freedoms Provisions

No personal information is collected without your knowledge, no personal information is transferred to third parties, and no personal information is used for purposes other than those stated.

In accordance with Article 27 of French Law No. 78-17 of January 6, 1978, relating to Information Technology, Data Files and Civil Liberties, you have the right to access and rectify any personal data concerning you.

Order Acceptance

he sales contract shall only be concluded after payment has been validated. The customer will then receive an order confirmation email from the Office de Tourisme Intercommunal Aspres Thuir.

The photographs illustrating the products are not contractually binding; therefore, they do not engage the liability of the Office de Tourisme Intercommunal Aspres Thuir.

By placing an order with us, the buyer expressly waives the benefit of Article 1587 of the French Civil Code. Orders placed online and validated in accordance with the established procedure, except where the legal right of withdrawal is exercised, are firm and final.

Validation of the order form implies acceptance of the specific conditions displayed on the screen, namely the product description and characteristics, quantities, and price.

The system implemented by the Office de Tourisme Intercommunal Aspres Thuir shall constitute the sole proof of the nature, content, and date of the order.

The Office de Tourisme Intercommunal Aspres Thuir reserves the right not to confirm an order and therefore not to register a payment for any reason beyond its control (in particular in the event of non-compliance with these General Terms and Conditions of Sale, supply issues, or disputes relating to a previous order).

Right of Withdrawal

In accordance with Article L.121-20 of the French Consumer Code, the buyer has a period of seven clear days from the date of receipt of the order to exercise the right of withdrawal and return the product to the seller for an exchange or refund, without penalty, except for return shipping costs. The goods must be returned in perfect condition and in their original packaging. The return shall be carried out by the carrier designated by the company L’OFFICE DE TOURISME INTERCOMMUNAL ASPRES THUIR.

Delivery

Our deliveries are made exclusively within mainland France (excluding Corsica).

Delivery can be made to your home, workplace, or any address provided when placing the order. However, the entire order can only be delivered to a single address. Deliveries are made from Monday to Friday (no deliveries on Saturdays, Sundays, or public holidays). If we are unable to meet the scheduled date, we will contact you before dispatching the wines. When indicated, delivery times are provided for information purposes only. Except where otherwise agreed between the parties, any delay cannot justify the cancellation of the order or a claim for compensation.

Delivery times within mainland France are generally 15 days after receipt of the order.

The customer is required to check the condition of the goods upon delivery by the carrier.

Damage or Missing Items Upon Delivery: In the event of missing items or damage, the customer must make reservations (note any issues) on the carrier’s delivery note, as the carrier is solely responsible for any damage caused. In accordance with Article L.133-3 of the French Commercial Code, any reservation must be confirmed by registered letter to the carrier within three days of receipt, with a copy sent to L’OFFICE DE TOURISME INTERCOMMUNAL ASPRES THUIR.

Acts of God and Force Majeure

L’OFFICE DE TOURISME INTERCOMMUNAL ASPRES THUIR L’OFFICE DE TOURISME INTERCOMMUNAL ASPRES THUIR shall be released from its delivery obligation in the event of unforeseen circumstances or force majeure, such as floods, fires, total or partial strikes, lock-outs, etc.

Transport

The goods travel at the recipient’s risk, regardless of the mode of transport or the payment terms for transport costs, whether carriage paid or carriage forward.

Product Availability

The wines and products offered are available as long as they are displayed on the website and subject to stock availability.

In the event of unavailability, we may offer you a full or partial refund of your order, which will be processed by bank transfer.

Sale Price

Our products are sold individually.

The sale price of the products is the price in effect on the date of the order, meaning the price displayed by the seller to the buyer on the website. This price may be modified without prior notice by the seller, provided that the buyer is informed before the conclusion of the sale.

The prices displayed in euros per product include VAT (all taxes included) and exclude delivery costs. Delivery charges will be calculated later depending on the quantities ordered and the delivery department.

All orders must be paid for either:

  • By credit card directly on the website via the secure payment system Stripe;

  • By bank transfer.

Fraud Prevention

L’OFFICE DE TOURISME INTERCOMMUNAL ASPRES THUIR reserves the right to request the following documents for your first order:

  • A copy of a valid national identity document (ID card, driving license, passport, etc.);

  • A copy of two (2) proof of address documents less than three months old (utility bill, telephone bill, rent receipt, etc.);

  • A copy of a company registration certificate (K-bis extract) less than three months old (for companies).

A confirmation email will be sent once the requested documents have been received and verified. Your order will then be reactivated and processed normally.

L’OFFICE DE TOURISME INTERCOMMUNAL ASPRES THUIR reserves the right to refuse any order from a buyer with whom there is an existing dispute or serious doubt.

Secure Payment by Credit Card (Stripe)

To ensure the highest level of security and reliability, we use the secure payment system Stripe.

A “secure” payment means that transactions carried out over the Internet are protected against unauthorized interception, modification, or alteration of the original message content. This system is based on SSL encryption technology (“Secure Socket Layer”: a secure form completed by the buyer when entering bank details). The protocol used is compatible with most internet browsers and ensures complete payment security.

Payment Process

After filling their shopping cart, the user selects one of the payment methods offered on the merchant’s website. A form then appears requesting bank details in order to obtain authorization from the bank. The required information includes the card number, expiration date, and visual security code (the last three digits on the back of the card).

Upon receiving the authorization response, Stripe simultaneously sends a response to the merchant’s server as well as a receipt.

The Stripe server then forwards the transaction for bank settlement (credit to the merchant and debit to the customer).

All exchanges between Stripe and the customer are encrypted. Only the Stripe server has access to the customer’s credit card number.

Bank Transfer Payment

If you choose this payment method, the shopping cart will be automatically validated. You will receive an order confirmation email containing the bank details (RIB) of L’OFFICE DE TOURISME INTERCOMMUNAL ASPRES THUIR.

You must then make a bank transfer for the total amount shown on the order (including the order number in the transfer reference).

The order will only be processed and shipped once the transfer has been successfully received in the bank account of L’OFFICE DE TOURISME INTERCOMMUNAL ASPRES THUIR.

Retention of Title Clause

By express agreement and as an essential condition of any sale, the transfer of ownership of the delivered goods is suspended until full payment of the price by the buyer.

Notwithstanding the retention of title clause benefiting our association, the delivered goods shall pass into the custody of the buyer upon delivery, who shall be responsible for safeguarding them and insuring them against any damage.

Jurisdiction Clause

All disputes relating to these terms shall fall under the exclusive jurisdiction of the Courts of Perpignan (66).
